I was just told my parked car was hit by a hit-and-run driver who was later caught. The driver said he would take responsibility for damages. I was told the car was probably totaled. I called my insurance and they said I could file a claim with them but I would have to pay a $500 deductible and get no rental car or I could wait to get the police report and if the driver has insurance and file a claim with them. There would be no deductible and I could get a rental car. I called the police station and they said the report would take two days. Is it better to wait and file with the driver's insurance or just file with my own and pay the deductible?

My vehicle was damaged when it struck a home owners large tree that fell in the roadway. Since it was the homeowners tree, can I look to the homeowners liability insurance to pay for damage to my vehicle rather than having a claim made on my auto insurance?

My son hit a lady's car who made a left turn against coming traffic. She was at fault and we have found out that she has no insurance. She lied at the scene. We had contacted the police and she will be fined and cited. We live in Louisiana and have the no pay / no play law. Our uninsured motorist coverage will covered our damage. My questions, the passenger in the other vehicle is now claiming to been hurt. She has contacted a lawyer and is trying to get our insurance company to pay her. What are the laws on the passenger? The lawyer says, that in Louisiana there is a law that says Cullen could still be at fault because of a 1% law. The police report clearly stated we were not at fault. What is the 1% law?

I was at a stop. The driver to my left put his blinker on to turn into the street I was at, he slowed and I started to pull out, he didn't turn and slammed my car. He had no license and was driving a relatives car. No adult was with him. I was given a warning for a violation of not yielding to to the right of way. Auto turned left in front of my vehicle at an intersection. The light was green and the other vehicle did not have a turn arrow. I hit vehicle that turned into my path. The liability insurance company of the vehicle at fault claims NC law provides that if I was considered 1 percent at fault they were not liable for the cost of my injuries or my vehicle. Is there a NC law that supports this? How is 1 percent at fault determined?

I fell off my husband motorcycle before the kick stand was down. I broke my ankles and have been out of work for ten weeks. I was in an accident last year. I was driving a rental car at the time and paid the rental expenses with a Visa card and declined the CDW on the car. The Visa company had to cover the damages to the rental vehicle as I fit into their category (according to their listed norms). I did not have collision damage insurance on my existing car. Now, Visa has agreed on a settlement amount which is less that the amount cited by the rental company and as such the rental company is charging me the difference. What do I do? I thought I was well covered but the Visa company says that they cannot force the rental company to reach an agreement. Does that mean I have to pay the difference? What options do I have, cause I think it is the responsibility of the Visa company to cover the damages and I should not have to pay any difference. Kindly advise.
