My brother was driving my car and rear ended a person. I have full coverage and he has only liability coverage. Will my insurance pay or his?

Your insurance should pay since it was your car that was being driven. There shouldn't be any issues with your brother driving if he is not excluded from the coverage. Most insurance policies define "Insured Person" as you or a relative or any person using your insured car with your express or implied permission to do so. However, if he is a household member than he may need to be listed on the policy in order to be a covered driver.

You should report this loss to your insurance company if you have not already. A licensed claims adjuster will be able to discuss the coverages and benefits on your policy with you.
