The other car driver is at fault in the accident and has no insurance. If my child, who resides in my household, is in that automobile accident as a passenger in the car which is not at fault for the accident, can a claim be made against the insurance company of the driver of the car in which my child was the passenger? Or, would I have to file a claim with my auto insurance company for my child's injuries?

You have a few things you will need to do. If you live in a state that requires personal injury protection, you will need to look into your policy and the driver's policy for coverage. Personal injury protection offers protection for injuries regardless of who is at fault in the accident. Beyond that, you will want to see if the driver and owner, of the vehicle your child was in, had uninsured motorist coverage. This coverage provides extra medical coverage if the other party was at fault in the accident and was uninsured or under-insured. You may also need to seek legal help to seek damages from the uninsured driver.
