I was rear-ended by a 16 year old who was speeding. That, in turn, pushed me into the path of an oncoming van. Needless to say, my car was totalled. My wife overheard the officer telling the 16 year old's mother that their insurance would be no good due to his age. How will this affect our claim? He was deemed at fault at the scene.

If the 16 year old was "at fault" for the accident, and he is uninsured, you will have a couple of options. First, you can get your vehicle fixed through your own policy if you have 'collision' coverage. 'Collision' is the impact of your vehicle with another object. This coverage will fix your vehicle up to its actual cash value. This takes depreciation into consideration. Also, your deductible amount will also apply. Some states offer uninsured motorist for property damage. I am not quite sure how this coverage works. But, I believe it covers your property to the limits of your policy, if it is damaged by someone who is uninsured. Beyond that, you will need to seek legal help.
