My husband and I lent our commercial truck to an employee with the specific duties to go to the court house, pick up materials, and go directly to the hotel. He checked into the hotel around 6:00 pm. He totalled the vehicle at 3:00 am with three unauthorized passengers. The driver was licensed but uninsured. The driver hit a lamp post, left the scene of the accident with minor injuries, and drove the vehicle untill it ceased. They were found pushing the truck and were questioned as to where

The insurance company will not cover the claim, because the driver did not have permission to drive the vehicle. I am not a lawyer but I believe the driver will be held accountable for his actions. The owner of the truck may also be held accountable for his actions (through vicarious liability). To keep you, your husband, and your company safe from litigation, I would seek legal help. And, as a result, you may have to sign an affidavit stating what limits of permission the driver had with your company's property.
