I had a 'dui' in Virginia years ago, and I am still required to carry an sr22. Now, I live in Florida and need to get Florida insurance. Do I need to have sr22 insurance in Florida, also?

You may want to contact the Virginia Department of Motor Vehicles for specific answers to your questions regarding your situation however normally the you will need a Florida insurance policy that meets the requirements Virginia has on you to show financial responsibility (SR-22 or FR-44). You will need Florida insurance since you now have moved to this state and that policy will need to provide a SRr22 for your VA case number. It will also need to include the Bodily Injury Liability limits and Property Damage Liability limits that satisfy Virginia.

From the information given on the VA DMV site it does not appear that now as an out of state driver that you will need to file the SR-22/FR-44 but you will have to prove your high limits to them.

The law regarding the SR-22 being now required to be a FR-44 went into effect January 1, 2008. This law requires persons with convictions related to driving while under the influence to have double the minimum automobile liability insurance coverage limits.

The VA DMV states that this law requires certain drivers to carry a FR-44, not just the usual SR-22. In Virginia the FR-44 certification is required on or after January 1, 2008 for the following convictions:

  • Maiming while under the influence
  • Driving while under the influence of intoxicants or drugs
  • Driving while the driver's license has been forfeited for a conviction, or finding of not innocent in the case of a juvenile
  • Violation of the provisions of any federal law or law of any other state or any valid local ordinance similar to the above

FR-44 liability insurance coverage limits are double the SR-22 insurance coverage limits:

  • Bodily injury/death of one person $50,000
  • Bodily injury/death of two or more persons $100,000
  • Property damage $40,000

The FR-44 doubles minimum coverage requirements applies to customers convicted of the above violations on or after January 1, 2008, as well as customers previously convicted of these violations that are required to file an SR-22 certification beyond December 31, 2008 the VA DMV states.

The VA DMV also notes if you reside outside Virginia, you may submit a letter on your insurance provider's letterhead stating the double minimum coverage amounts. So you should speak to your FL auto insurer about getting such documentation and the VA DMV to make sure that your insurer sends in the right paperwork so that you do not get penalized in any way.

If the VA DMV does not receive the FR-44, or other accepted paperwork from out of state residents, the DMV states they will suspend the person's privileges to:

  1. Drive
  2. Register motor vehicles in Virginia
  3. Obtain decals in Virginia.
