Car Insurance Question  I had an accident. The car is 'totaled' according to the insurance company. In their settlement offer, they list several small dents that were not caused by this accident and claim that pre-existing damage is $1,500. They want to deduct that amount from the settlement offer. Is this a common pratice? Some of those dents were there when we bought the car.

If your vehicle is 'totaled,' and you are using your comprehensive or collision coverages, your insurance company will only pay for your vehicle's actual cash value for which they are responsible. They will not pay for any pre-existing damage. This pre-existing damage should be compensated to you when you purchase the vehicle. In other words, you probably spent $1,500 less to purchase the vehicle than you could have spent if there were no previous dents.
