I recently married and still have my current car insurance. My husband still has his own policy. He backed into my car in our driveway. He admitted he was at fault. But, his insurance adjuster said that because we are married, technically his insurance does not have to pay for my damage. As a result, I have to claim my damage on my own insurance. How can this be when it's his fault? (Now, we have to pay 2 deductibles.)

In most cases, his insurance should pay to fix both vehicles. His 'collision' coverage on his policy will cover the vehicle he was driving up to its actual cash value. This will take the vehicle's depreciation into consideration. Also, he will need to pay for the deductible he chose. If he has 'property damage liability,' this will help protect the vehicle he hit up to the limits purchased on his auto insurance policy. There will be no deductible to be responsible for with his 'property damage liability' coverage. It sounds like you have 'collision' coverage for your vehicle, too. If he does not have 'property damage liability' on his policy, you can get your vehicle fixed through your 'collision' coverage. Your deductible will apply.

car insurance commentsI hit my husbands truck with my car in the driveway and Alfa, my insurance, paid to fix my car (collision). His company Progressive paid to fix his car (also collision). Then a year later Progressive collected the amount back from me which I paid out of pocket. What happened was Alfa denied my liabiliy coverage based on the covered person clause which I guess is the same as the household exclusion. So I guess there is a possibility that your insurance company may try to collect from your husband the amount it cost to fix your car. yuck.
