I was 'rear-ended' 3 years ago - which was not my fault. My driving record reflects the incident as an 'at-fault' accident. As a result, my insurance is affected. What can I do? I also made an insurance claim last year when my engine failed and had to be replaced. This, too, was considered an "accident" and my insurance is now through the roof. Why am I being penalized for two things that were out of my control when they occured?

Insurance companies are required to file their rates and rules with state regulatory bodies such as the Department of Insurance. In most cases, they impose a surcharge or charge 'points' to driver's who have been charged with an accident and/or who have made a claim against their policy. It's just a matter of how the rates are filed and passed on to you as a result of your two claims against your policy. Now, if all you did was report these two incidents to your insurance company, and they did not payout for the claims, you may want to consult your state's Department of Insurance to see if they can help you.

In addition, you should get a copy of your driving record to determine why it reflects an at-fault accident if you were not at fault. You can contact your state's motor vehicle department to determine how to correct erroneous entries on your driving record.
