I was involved in a accident in December 2004. Since then, I have been back to the dealer that fixed my car with more issues that were not listed on my repair, and most of them are from the accident. They have already done $10,600 worth of repair to the car. (Kelly Blue Book says its retail value is $15,600.) At what point can I say that the insurance company needs to "total" the car? I am taking it to another shop to get a new estimate on it, and they said they can file a supplement.

Unfortunately, the insurance company is going to be done when they have paid up to the vehicle's "actual cash value" (which takes the vehicle's depreciation into account) minus your deductible. This will take into account what they have already paid. Because of what they have already paid, I do not believe they will "total" your vehicle. What you may want to do is seek legal advice against the dealer - who can't seem to fix your vehicle properly.
