Car Insurance Question  My daughter was recently hit by another insured driver. (The other driver is determined to be at fault.) Her car was evaluated to be "totaled" by her insurance company. They are offering a settlement which is substanially below retail market value. Also, she is subject to having to pay for additional rental car time. Other than retaining legal counsel and seeking damages to make her whole, what are her options?

Without considering legal options to make your daughter whole, your daughter's next move depends on what you mean by "her" - when you say "by her insurance company." If "her" is referring to the other driver, then your daughter can try to seek restitution for her damages if she has "collision" coverage. This coverage covers damage to her car when her car hits, or is hit by, another vehicle, or other object. It pays to fix her vehicle up to its "actual cash value" less the deductible she chose. Now, if you meant your daughter when you said "her," then the other driver should have "property damage liability" to help pay to fix your daughter's vehicle.
