A truck hit me from behind with such a force that it caused me to slam into the back of the vehicle in front of me. The vehicle in front of me also slammed into the rear of the vehicle that was stopped at a traffic light. My vehicle was the only one that was totalled. My passenger was taken to the hospital by ambulance for test and released the same day. If the driver at fault only carried $10,000.00 worth of property damage, what percentage of that will I receive for my totalled vehicle if the other 2 claimants have to get a settlement also? (I was not carrying collision and the damage estimate for my vehicle was $11,500.00) My auto insurance company is covering 80% of the medical bills (over $6,000) for my passenger. Is the auto insurance company of the person at-fault responsible for the remaining 20% even if he has only PIP coverage and no bodily injury coverage? (My passenger does not own a car and therefore had no auto insurance.)

Ultimately, you will need to check with the at-fault party's insurance company to see how they are going to handle your claim. (Also, you may want to seek some legal help with your claim.) But, in general, there is no percentage of property damage that is divided amongst the claimants. Also, in general, the auto insurance company of the at-fault party most likely will not contribute towards the remaining 20% of medical expenses incurred by the passenger of your vehicle.
