I drove over a tire that was laying in the middle of the road during the middle of the night. The tire caused damage underneath my car. Will my insurance premium go up as a result of this? Would this be considered my fault?

Driving over debris in a roadway is not uncommon. Insurance companies know it is sometimes impossible to avoid debris so it is unlikely they will assign fault in this sort of incident.

If you have comprehensive covereage on your vehicle you should be covered. It is up to the individual insurance company to decide on if your premium should be raised but unless you have made several claims recently it would typically unlikely for your insurance to go up from this one incident.

car insurance commentsThe answer is completely reasonable. However, this recently happened to me and my adjustor insists that I was pricipally at fault! I have been an accident- and claim-free customer who buys far more than the minimum coverage for 10 years and am very unhappy with the way I am being treated.
car insurance commentsIf the object was stationary in the road, and the driver collides with it, this is an at fault accident, since it is the drivers responsibility to be alert to conditions and obstacles. However, if the object is moving (for example, if something flies off a dump truck and hits the vehicle), that would not be considered at fault.
