My sister was invoved in an accident as a passenger with a driver who has no auto or health insurance. The driver of the car that my sister was a passenger in was at fault and put her and my sister in the hospital. She also put 2 or 3 people from the other car who was not at fault in the hospital. My question is, in Florida who is responsible for the medical bills of my sister if the driver doesn't have insurance?

Ultimately the at-fault driver and the driver's bodily injury liability is responsible to cover your sister's bodily injury claims, IF they have BI coverage.

In Florida, bodily injury liabiity is not required though. PIP is intended to cover personal injury protection before BI is used. If the driver of your sister's car has PIP it would be primary, then your sister's PIP would be secondary (supplemental). Then, the at-fault driver's BI would be tertiary (supplemental).

If there is no PIP or BI to cover the claim, you will need to seek damages from the at-fault individual through the courts.

car insurance commentsI can relate, because my son was involved in an accident where he failed to yield the right of way and was hit, but the other driver was speeding. The car my son was in was his girlfriends and she did not have any insurance, so since my son is 17, I am liable for damages. I was told that my insurance on my vehicle might pay for it. car insurance commentsIf the sister has her own car, her PIP would be primary. If she does not have her own car she would seek to get PIP through a resident relative. If no household PIP is available she would then seek PIP through the car inwhich she was in at the time of the accident
