According to the New York Department of Motor Vehicle's Governor's Traffic Safety Committee the penalty for a first time offender who passes a stopped school bus with flashing lights is 5 points on the license and a fine. The fine is for not less than $250 but not more than $400 or imprisonment for not more than thirty days. Both the fine and imprisonment can be sought by the law enforcement agency and court as well.
Passing a stopped school bus is a serious offense in NY like it is in most all states. If you are cited a second time within a 3 year period the fine will be for between $600 and $750 and/or imprisonment for not more than 180 days. A third offense within 3 years will get the offender a fine of between $750 and $100 and/or imprisonment for not more than 180 days.
