A friend of mine is driving with no insurance. What would happen if they had a crash and somebody was killed? What would happen to them, would they get jail? They live in Miami, FL.

Florida has financial responsibility laws for drivers with and without insurance. I will explain that after your question is answered.

If someone is killed in an accident, it is up to law enforcement to determine if manslaughter or any other charge should be recommended or charged by the district attorney. This is regardless of the amount of insurance that is carried.

Insurance is meant to protect drivers from their liabilities, like hitting property (a car) or injurying and/or killing people. States inact laws to set requirements on drivers to help protect themselves, but many times the coverage is not enough for the drivers that actually need the coverage. For example, a new 16 year old driver is more likely to need $300,000 in liability coverage, but they don't buy any because it is not required by Florida law and it is too expensive.

The sole purpose of financial responsibility laws is to ensure that people are responsible for their actions involving motor vehicles. The rules in place are there to make sure everyone has insurance to pay for the damages they cause, or they may cause, when they own a motor vehicle or register a motor vehicle.

The Bureau of Financial Responsibility will help parties recover damages and be compensated for injuries. A final judgement from a court is entered against the at-fault party.

  1. If the party had PIP insurance but no Bodily Injury coverage and there are sustained damages and injuries, the judgement will be enforced for injuries. While normally the law provides authority to suspend a license of an uninsured party only for 3 years, in case there is a judgement, they have the authority to suspend licenses, tags and registrations for a period of 20 years or until the judgement is satisfied.
  2. If the party had no insurance at all. The judgement will be immediately enforced and the at-fault party's license, tags, and registrations will be suspended for 20 years or until the entire judgement is satisfied.
