If a car insurance company has inspected and then cut the check on a accident claim to repair the claimants vehicle, can the claimant then deposit the check into his personal bank account and pay the auto shop out of pocket? Basically who does that money belong to, the claimant or the auto shop?

Insurance companies differ and state laws vary regarding the question you asked. If the check was only made out to you only, and not to both you and the repair shop, generally you can deposit the check into your personal bank account. Once you do this you can then write a personal check or take out the cash to pay for the repairs.
