I was involved in an accident where someone stopped at a stop sign and then proceeded to pull out in front of me. It was clearly his fault and he stated he didn't see me. His insurance company had decided that I'm at partial fault and will not pay me in full. If I do not agree with what I've been paid, what is my next step? Do I ask for someone else to review the claim? Do I take the insurance company to small claims court? Or do I take the person that hit me to small claims court?
