I was recently involved in an accident. I was the passenger in my boyfriend's car and we were hit but it was determined to be his fault. Both drivers have insurance. My boyfriend and I were taken to the hospital and as a result have expensive medical bills. His insurance company says they will cover his bills but I have to use my insurance company to cover mine. Isn't his insurance company responsible for paying my medical bills?

Since your boyfriend was found at fault it is possible that his auto insurance is responsible for your medical bills. It depends on what type of coverage your boyfriend has and your state laws to what his auto insurance will be required to pay.

If your boyfriend has bodily injury liability it typically would cover your injuries resulting from the accident. If he had personal injury protection coverage your medical bills again would typically be covered, within the limits to which he purchased.

Laws differ on this depending on the state and if it is a no-fault state or not. I would contact the claims adjuster from your boyfriend's insurance company to get specifics on what they will or will not cover and the reason why. If you are not satisfied with their response you can always get legal advice.
