I was in an accident and my car was damaged, but not beyond repair. The accident was the other guys fault and his insurance is handling the claim. However, they have told me that the value of the car is less than the cost to get it fixed, so that is what they are deciding to pay me. Can I demand that they have the car fixed instead of totaled-out?

Insurance companies generally make a settlement offer if the repairs will cost the same or more than what your vehicle is worth instead of fixing your vehicle. You should discuss with the claims adjuster on the case to see if you have options other than them totaling out your vehicle.

State laws may vary regarding your type of situation so you might get legal advice or contact your state's insurance regulatory body to find out more information on this type of situation.
