Someone in my household took my car without permission. He then got into an accident (who is to blame is still undetermined). He has no insurance for himself. What happens? Will I be at fault even though he took my keys without permission? I live in Massachusetts.

If the household member that took the car is found to be at-fault in the accident there is the possibility that you could be held liable since you are the owner of the vehicle. Since the person was a household member and if they are licensed it is likely that your insurance company would have wanted them listed on your policy unless you requested them to be excluded.

If the other driver is found to be at-fault generally you would be able to then file a claim with their insurance company since you are the owner of the vehicle. If your household member is at-fault you can contact your insurance company to find out where they stand in the situation but might have to also get legal counsel regarding Massachusetts state laws and your circumstances.
