My car was parked in a parking spot and a Plow hit it and my car is all screwed up. I just bought the 2002 RSX a month ago. The car had no problems before and now I am out of a car and it is going to be in the shop. I was not involved in this accident, my car was parked in a parking lot and the plow just smashed in to it, while I was at work . I am in college and have two jobs and a car loan on this. I want the truck company to get me a new car. I do not want them to just fix this one. It will have problems now, and it will have an accident on the car's record. Just wondering what to do?

To get the settlement you want you will need to work with the claims department of the truck or snow plow's insurance company. If they do not deem your car a total loss then most likely the insurance company will want to pay to repair the vehicle. If the car is found to be a total loss (basically it will cost more to repair than the car is worth) then you will get likely get the actual cash value. You then could pay off your loan and look for a new vehicle to purchase.

Speak with the claims department about what outcome you want and then negotiate with them depending on their response. Understanding the Function of an Insurance Adjustor will help you in your negotiations with the claims department.
