Car Insurance Question  My truck was parked at my friend's house, beside of his 1999 BMW, when a lady hit the pansenger side of my truck at high speed and pushes my truck about 8 to 10 feet and it hit my friend's BMW. The lady doesn't have insurance. My truck was totaled, the frame was bent is undrivable. What can I do and who will pay?

First and foremost you should call the police and make a report about the accident if you have not already done this. This will not only help state your case in the future but hopefully the lady without insurance that damaged both cars will get cited for her violation of the law.

If you and your friend have collision coverage or uninsured motorist coverage on your vehicles you can most likely make a claim with your respective insurance companies for the damages. It would appear that both you and your friend would be responsible for contacting your own insurance companies regarding the damage since it was not your fault that your truck was pushed into his BMW. You each will have to pay your own deductibles for making the claim.

If you or your friend do not have collision coverage you will likely need to get legal advice to see if your state allows you to take legal action against the uninsured motorist that damaged or totaled your vehicles. Even if you do use your insurance you might want see if you can legally get your deductible money reimbursed by the at-fault party.
