I was recently in a 3 car accident and my car was declared a total loss however the at fault person's insurance is saying that because the Property Damage coverage is only $5000, that they will have to split that amount between me and the other person. I was under the impression that I am entitled to at least the Blue Book value ($7450) and rental car allowance. Please advise

In most states the minimum limit for property damage is $10,000 or more. There are very few states that allows for a minimum of $5000 so check to make sure your state is one of them or the other person should have a higher limit for property damage.

In most cases you would receive the actual cash value of your vehicle because it would be within the limits but you can only receive from their insurance company up to the limits they've paid for. Insurance companies vary on their rental car allowance so check with the one you are working with to see what their rules are on this.

Since this was a multi-car accident it appears to be even more complicated. You might need to involve your insurance company or obtain legal counsel to be fully compensated.
