Car Insurance Question  Ryan is 17 years old and lives in New Jersey. His car is owned by his father and he is covered under his father's insurance. His father is not expected to live more than a few weeks. He will live with his 22 year old sister after his father dies, but she does not drive and does not have a drivers license. Is it possible for Ryan or his sister to own a vehicle and obtain insurance?

In New Jersey it should be possible for 17 year old Ryan or his 22 year old sister (if she acquires her driver's license) to own a vehicle and obtain insurance. In NJ one must be at least 17 to register a vehicle. The NJ Motor Vehicle Commission states that a car registered in the name of a decedent may be operated for 30 days after the death by an immediate family member or any licensed driver who has permission from the surviving family member.

The MVC has certain rules for how to transfer the title if the vehicle is left in the will, to an estate or without a will. So that the car can be properly titled after Ryan's dad's passing, contact the MVC for specifics. It would also be wise to speak with the dad's car insurance company now to find out what it will take to change the policy after his death.
