In Pennsylvania they allow for an Accelerated Rehabilitative Disposition (ARD) for first time DUI offenders. When a DUI violator is accepted into an ARD program the state suspends their charges but requires that certain court ordered conditions are met. These conditions may include drug and alcohol counseling, community service, etc. Similar to a probationary program the ARD program requires a period of supervision. In essence, ARD is a one-time alternative to a trial, conviction and possible mandatory jail sentence for the offense of driving under the influence in PA. To be in the ARD program there is a $500 processing fee plus you can expect to pay a fine, court costs, a fee for alcohol safe driving class and a probation supervision fee. Once you have completed your ARD program, the original criminal charges are dismissed. You may request that the court expunge the arrest record but the DUI or ARD will be noted on your driving record. PennDOT will automatically expunge ARD records after 10 years, provided that your operating privileges were not revoked as a habitual offender. According to the Pennsylvania Insurance Department, if you are convicted of a DUI, whether or not you complete an ARD program, your license will be suspended. This alone is a valid reason for insurance companies to raise rates, cancel or non-renew your policy.
