Car Insurance Question  My husband had a car accident and the cop said that it was his fault because he was coming out of the turning lane but the other car did not have his headlights on. How is that his fault, if he could not see him coming without headlights? My husband was not insured, what will they do to him in court? We live in Tennessee.

In Tennessee, failure to show proof of financial responsibility is a Class C misdemeanor whose penalty is a fine of not more than $100. Once the state is notified of a conviction for this offense, the violators driver's license will be suspended.

Also a STOP will be placed against the vehicle's registration of the driver. If financial responsibility can be shown prior to the court date though they might be able to dismiss charges, the driver will need to submit proof of Financial Responsibility again to the TN Financial Responsibility Division before their registration is renewed.

Because of your husband being uninsured and being in an accident there could be more penalties as well, such as being required to file a SR-22. It appears that because of the police citing him at fault, he could be held responsible for the damages if the other party does not have insurance that will cover their own vehicle.

If the other party does not have these types of coverages they will likely look to your husband to pay. TN typically will make an at-fault uninsured driver post a bond to cover the other party. The other party can report your husband to the TN Department of Safety if he does not reimburse them for the damages.
