California Vehicle Code 23223 is the law against possession of open container in motor vehicle. This VC basically states that no driver or passenger shall have in his or her possession, while in a motor vehicle upon highway or on lands, any bottle, can or other receptacle containing any alcoholic beverage that has been opened. It does not appear that this violation of the CA law carries any points but comes with other penalties such as a fine. So while points may not be assessed, the infraction will likely be reported to the California DMV so that it will be added to your driving record. The next time your insurance company pulls your driving history record they could see the violation of the law and depending on their insurance rating system could raise your premiums.
