Car Insurance Question  I live in Kansas and was ticketed for a tail light being out and not having insurance. I went to court paid my fine and showed proof of insurance I now have. I was fined an additional $300 for no proof of insurance at the time of the violation. Two months later I received a notice from the Internal Revenue stating that I had to get SR22 insurance. I still have my insurance policy, why didn't the courts mention this and why do I need it if I wasn't in a wreck?

Kansas law mandates that every automobile insurance policy sold in the state must have these minimum coverages:

  • Liability Coverages of 25/50/10
  • Personal injury protection (PIP of No Fault) of: $4,500/person for medical, $900/month for 1 year for disability/loss of income, $25/day for in-home services, $2000 for funeral expenses and $4,500 for rehabilitation expenses.
  • Uninsured/Underinsured Motorist of $25,000/person and $50,000/accident.

According to Kansas statute 40-3104 a first time offender found driving without insurance must pay fines between $300 to $1000 in addition to losing their driver's licenses and vehicle plates, both of which can be reinstated through payment of a fee and proof of insurance coverage.

It would appear that when you paid your fine and showed current proof of insurance at the courthouse you were able to reinstate your license and plates. The Kansas Department of Revenue might have found out at a later time about this loss of driving privileges and thus sent out the notice for a SR-22, financial responsibility certificate.

The SR-22 can be required in Kansas to reinstate a driver's license so you will need to check with the KS DOR to find out if your must file it or if because of the steps you have previous taken this will not be required. If you do need this insurance, you can get an online auto insurance quote.
