Car Insurance Question  My husband and I recently purchased a new (not used) car but could not take the vehicle home as it had no arrived at the dealership. All the paperwork was exactly as if we had taken the car and given the trade. We walked out with an "we owe" from the dealer. This was done to secure dealer financing. They let us take home the car we traded in. My husband hit an animal on the highway and now the dealership says our insurance must pay or we pay. If we legally traded the car, whose insurance should cover the car?

Your situation is a unique one and state laws can differ so what we can offer is a general answer. Getting hit by or hitting an animal is typically a comprehensive claim you put through your own insurance company.

It sounds as if the paperwork was filled out but not totally finalized since you did not take ownership of the new vehicle you were buying and the dealership did not take possession of the vehicle you were trading in.

If the car you are going to trade in is still registered in you and your husband's name than it would appear that you would still be the owners of it and need to put the claim in through your insurance company. Also your husband was in control of the vehicle when the accident occurred.

If instead you signed over the title to the dealership and it is no longer in your name, it could be the dealer's responsibility to carry the insurance on it while you "borrowed" the car back.

Check with your insurance company and perhaps also the state insurance regulator to make certain whose insurance company is actually responsible according to state laws.
