Car Insurance Question  I got a reckless driving citation in Virginia but I am a Delaware resident. The attorney says he can try and get the charge converted to either improper driving or speeding. How would Delaware assess an improper driving ticket? Which charge would have less impact on my insurance?

As you are likely aware both Virginia and Delaware are part of the Drivers License Compact (DLC) so the violation that you are convicted of in Virginia will be reported back to Delaware.

The Delaware Division of Motor Vehicles states that they include on your DE driving record all convictions, even those committed in other states. It does not note if points are assigned for these out of state offenses.

According to the Delaware point system speeding, depending on the amount over the speed limit, is a two, four or five point offense. Improper driving is not listed so would likely go under the "other moving violations" which have 2 points assigned to them. This can help you see which violations the DE DMV find more serious.

You can check to see what "other moving violations" are if you look at Title 21, chapters 27, 42 and 44 of the Delaware Code which can be found at ww.delcode.state.de.us/title21/index.htm. To find out for certain how the Delaware DMV would assess an improper driving ticket you should contact them.

Improper driving and a speeding ticket might be the same to your insurance company or one could be weighted more heavily than the other. Since each individual insurance company has their own way of rating, you will have to check with your auto insurance provider to find out about their rating system and various traffic tickets.
