Car Insurance Question  Is it West Virginia state law that medical coverage follows the owner of the auto rather than the insured when the insured is driving someone else's car?

Typically medical payment coverage pays for you, your family members and passengers whether you caused the accident or not. Depending on the terms of the policy you might also be covered if you are injured in someone else's car or hit by an automobile will walking or bicycling.

We have not found any information saying that West Virginia differs in the way its auto insurance medical payment coverage is dispensed. To find out for certain you can go through the West Virginia Code at www.legis.state.wv.us. Insurance is under section 33 of the WV Code.

It might be easier to contact the West Virginia Insurance Commission consumer division to determine if there is a state law regarding if medical payment coverage follows the owner or the insured instead of going through the whole WV Code for Insurance.
