| West Virginia laws require all motorists to be insured and registered vehicles to carry a minimum amount of insurance coverage. This minimum is $20,000 for one accident, one injury, $40,000 for one accident, 2 or more injuries and $10,000 for property damage. West Virginia has several penalties in place for motorists who fail to show proof of insurance, regardless of accidents being involved. Penalties can include suspension of your vehicle registration and drivers license as well as criminal penalties that could result from a conviction in magistrate court. Criminal penalties for driving without insurance can include fines of between $250 and $5000 and jail time of between 15 days and 1 year or both. These penalties as well as others will likely apply to you if you were cited at the scene of the accident for driving without insurance. If instead you were the one at fault in the accident, the other party would be allowed to file a judgement through civil court against you.
