The Virginia DMV's driver's manual lists penalties for a first time DUI offense and/or breath test refusal, to include an automatic administrative suspension of your driver's license for 7 days if your BAC is 0.08 percent or higher. It is also a 6 point violation for your driving record.
A conviction of a DUI (VA Code 18.2-266) offense in VA will result in a mandatory minimum $250 fine, the suspension or revocation of your driver's license and other penalties in addition to the administrative license suspension.
Since you were in an accident as well, depending on local ordinances, you may be liable (for up to $1,000) for the cost of law enforcement, emergency medical services, fire fighting and rescue personnel who respond to a crash or incident resulting from your DUI violation.
The SR-22, financial responsibility certificate, is required in Virginia if you have an unsatisfied judgment, an uninsured motor vehicle suspension or driver license suspension as a result of a major conviction. It would appear that you may be required to carry an SR22 because of the latter, a DUI violation conviction.
As for how much your insurance rates will increase if you are convicted of a DUI or DWI will depend upon your insurance company and their rating system. Typically rates do go up since many insurance providers find a person with a DUI on their driving record to be high risk to insure. To find out about your insurance carrier's rating system you will need to ask your agent or contact the VA insurance regulatory body with whom rates must be filed.
