My daughter, who has a Maryland provisional license was issued a speeding ticket in Delaware. How will this effect her, will there be points assessed and will she have to restart her provisional period?

Maryland and Delaware are both part of the Drivers License Compact (DLC). As members of the DLC they are required to report tickets received by motorist back to the state where they are licensed to drive. So the Maryland Motor Vehicle Administration (MVA) will be informed by the Delaware courts or Division of Motor Vehicles of your daughter's speeding ticket.

The Maryland driver's handbook states that once the MVA receives ticket information from another state they treat it as if the violation occurred in state. If the MD MVA does treat the DE speeding ticket as an in state offense than it would go on your daughter's driving record and be assigned points.

As for her provisional license, it must be held for 18 months with the driver free of moving violation convictions. According to the MD MVA if convicted of a moving violation, the driver must restart an 18-month waiting period with no additional moving violations. Only then can a driver become eligible to convert to a full driver’s license.

The MD Graduated Licensing System rookie handbook also notes that convictions or "Probation Before Judgment" (PBJ) for moving violations while holding a provisional license will require the completion of a driver improvement program and/or the suspension/revocation of the teen's driving license.

For a first conviction it is the driver improvement program, subsequent convictions will bring about the stiffer penalties such as a suspension or revocation. For more information, you or your daughter can contact the MD MVA.
