Car Insurance Question  I got caught twice in a speed trap in Georgia. The first time for going 21 mph over the speed limit the second time for going 28 mph over. How many points will I get? How long do the points stay on a persons record in Georgia? What happens if I exceed the maximum amount of points?

In the state of Georgia after a conviction of a traffic offense, the court will forward notice of that conviction to the Department of Motor Vehicle Safety (DMVS). For the purpose of identifying habitually dangerous or negligent drivers and habitual or frequent violators of traffic regulations governing the movement of vehicles, the DMVS shall assess points.

The Georgia points lists for speeding is as follows:

  • 15 mph but less than 19 mph is 2 points
  • 19 mph but less than 24 mph is 3 points
  • 24 mph but less than 34 mph is 4 points
  • 34 mph or more is 6 points

So for your first speeding ticket it would be 3 points and then 4 points for the second citation for a total of 7 points. The Department is authorized to suspend your license if its records or other evidence shows that you have accumulated 15 points within 24 months under the point system, including violations committed out of state. At the end of the period of suspension, the violation point count shall be reduced to zero points.

According to Georgia Code 40-5-57, the court may order a person to attend a driver improvement course for any violation for which points are assessed against a driver's license or may accept the attendance by a person at a driver improvement clinic after the issuance of a citation for such offense and prior to such person's appearance before the court, in which event the court shall reduce the fine assessed against such person by 20 percent, and no points shall be assessed by the department against such driver.

The disposition and court order shall be reported to the DMVS and shall be placed on the motor vehicle record with a zero point count. This plea may be accepted by the court only once every five years. From this information it appears that for one of the speeding ticket you may be able to request taking a driver improvement clinic and though the offense will go on your record, points would not.
