Can an at fault party's insurance company (Geico) require that you take your car to their preferred body shop to meet an adjuster in order to get your settlement for minor damage to your car? My car was parked legally and I was not in it when it was hit. Geico is giving me appointment times between 8:30 am and 12:30 pm during weekdays only. This does not work out with my work schedule so they suggested that I have a friend do it but I don't have any friends that are available to do this either. I live in TN and this occurred in TN. Do I have any other options? Can I insist that an adjuster come to my house or work?

Insurance company guidelines as well as state insurance laws differ but an adjuster may be able to be sent to your house or workplace. It is likely though that you would still need to take the vehicle into a repair shop so that the estimate is complete. At a repair shop the mechanics should have access to what the parts to repair may cost, something an adjuster likely would not have the ability to look up if he viewed your vehicle away from a mechanic's garage.

If the hours they are giving you are unreasonable due to your work schedule you should continue to discuss this with the adjuster so that they will change either change the hours or see if there is a different repair shop that you can meet the insurance adjuster at during your lunch hour or after work.

Many states require that if an insurance company offers a preferred repair shop and it is used for the repairs, the company must guarantee the repairs or can be held responsible for the quality of the repairs. If you chose your own repair shop to do the work, the insurance company will pay based on an agreed upon repair estimate but not guarantee the repairs, nor will they be responsible for any delays in completing the repairs.

While many insurance companies maintain lists of preferred or approved auto body repair shops, which the insurance company might recommend the consumer use, normally you have the choice of whether or not to use an insurance company’s preferred shop. To find out what specifically your consumer rights are in this situation contact the Tennessee Department of Commerce and Insurance.
