I have a teenage daughter (19) who is currently under my car insurance. I insure two cars, mine and hers. Recently, I transferred title of one car to her and she has moved out of my residence and is no longer part of my household. My insurance agency told me that it is the law that before I take her off my policy she must show proof of new car insurance. I was told from another source that is not true. I just need proof of her new address or proof the car title is in her name. I do not want responsibility for her driving now that she is out of the house and the car is in her name.

The guidelines of how to take a driver off of a policy is normally up to each individual company. The reason an insurance carrier is so concerned about you showing proof that your daughter now has her own insurance policy is because they may still be liable for damages if the driver is in fact still living in the house and is driving the car without having another insurance policy on it.

State laws differ so the best way to find out for certain if your insurance company needs by law proof of your daughter's new insurance coverages, or if instead it is their own company guidelines requiring this in order to take your daughter off of the policy, is to contact your state's insurance regulator.

This state agency should be able to tell you if your state requires this proof or if it is something that your insurance provider can require of you in order to take your daughter off of your policy. When it is required by a policyholder to show proof that a person moved or has another auto insurance provider is for the safety of other motorists. This is because your insurance company and / or the state want to make certain that your daughter is not driving without insurance.
