Car Insurance Question  Last night I was driving home in Massachusetts and got a speeding ticket of $250 for doing 75 in a 50 zone. This is my first speeding ticket. Will I be surcharged on my insurance?

In Massachusetts normally if you have at-fault accidents or commit traffic violations, your driving record will accumulate surcharge "points" depending on the nature of the incident. You accumulate surcharge points if you are responsible for an accident or commit a traffic violation.

You also receive surcharge points if you are convicted of, or pay a fine for a traffic violation; or are assigned to a drug or alcohol education program. If you disagree with a traffic violation, you must appeal it through the court system. Traffic violations cannot be appealed to the Division of Insurance Board of Appeals or the Merit Rating Board.

The MA Division of Insurance's fact sheet on the Safe Driver Insurance Plan states that no surcharge points are assigned to the first non-criminal minor traffic violation in the 5 years immediately preceding the effective date of your policy.

From this information it would appear that since this is your first ticket it may not be surcharged, but like any policy your rates could increase because discounts (safe driver) are removed. To find out for certain the DOI says to direct questions about the Safe Driver Insurance Plan to the Merit Rating Board's Customer Service Section at 617-351-4400.

car insurance commentsI called the DOI (at 617-351-4400) this morning. The man I spoke to told me that a first speeding offense in Mass. *will* cause your auto insurance rates to be higher. It sounds like, while the rates may not actually go up for someone who pays a speeding ticket, such a person will not get a discount that would be applied if there had not been a ticket.
