Car Insurance Question  A cab driver hit me from behind. I live in the state of NY where the person at fault is always the person who hits from behind. I have contacted the company that leases the vehicle to the driver and they want me to send a claim form. Since my deductible is more than the cost of fixing the damages, should I contact my company to send a claim or can I send a claim letter to the cab's company?

Since the cost to fix your vehicle is less than your deductible, an insurance company would not usually even take your claim. If this is the case then you would want to send the claim letter to the company that leases the vehicle to cab driver as they requested.

Since typically an insurance company will decline any claim that is less than the deductible amount then it would appear that the way in which to get your car fixed from being damage it sustained when it was rear-ended is by going through the property damage liability coverage of the vehicle that hit you.
