Car Insurance Question  I live in Arizona and I was pulled over the other day in my dad's car, my dad's car does not have insurance, but my car that I own has insurance. I don't drive my dad's car anymore and my dad is selling the car I was pulled over in. I was wondering if I can show proof of insurance from my car and get out of paying the fine for no insurance or do I have to put the car I was pulled over in onto my coverage before he sells the car? Also can tell me, how much a fine for driving without insurance is in the state of Arizona?

You will need to find out from the Arizona court, which should be listed on the ticket for no insurance, what you need to do to take care of the ticket. From the information we have found it looks as though the fine for driving an uninsured vehicle in Arizona is about $500 and other penalties may also be assigned by the court.

Arizona Revised Statute (ARS) 28-4135 requires financial responsibility to be on a motor vehicle. This is a civil law and carries a penalty of a fine along with a surcharge and court fees.

Part D of this Statute states that a citation issued for violating this law shall be dismissed if the person to whom the citation was issued produces evidence to the appropriate court officer on or before the date and time specified on the citation for court appearance and in a manner specified by the court, including the certification of evidence by mail, of either of the following:

  1. The financial responsibility requirements prescribed in this section were met for the motor vehicle at the date and time the citation was issued.
  2. A motor vehicle or automobile liability policy that meets the financial responsibility requirements of this state and that insured the person and the motor vehicle the person was operating at the time the person received the citation regardless of whether or not the motor vehicle was named in the policy.

From part 2 above it appears that showing insurance on your own vehicle and for you as a driver may be enough if your insurance company will provide you with proof to show to the court that your policy would have covered the motor vehicle if it was in an accident while you were operating it.

If your insurance company cannot provide this then ARS 28-4137 states that if you obtain insurance after the date and time of the violation, mail or present proof of a minimum of 6 months insurance the court may reduce or waive the amount of the penalty. So if your insurance is not enough for the court then you or your father may need to get a 6 month policy on his vehicle to take care of your citation.

If you do end up with a civil penalty due to this citation, the penalty listed in the ARS Statute 4135 is a fine of $500 for the first violation and the court may direct the AZ Department of Transportation to suspend the driver's license of the person and the registration and license plates of the motor vehicle for 3 months.
