Car Insurance Question  I was rear ended by an SUV while waiting at red light to take a right. The person who hit me admitted he was at fault. He did not have any kind of insurance. I collected as much of his information as I could including his license info, address and phone numbers. He requested me not to call police as it was a minor accident and he agreed to pay for the repair. So we did not call police. Now he is trying to avoid me either saying that he is busy or by not picking up the phone. It happened in Texas yesterday. Is it too late to call police and report (after one day ) the accident since he is not responding to my calls? I called my insurance and they said they can get the car fixed up under my collision coverage and try to subrogate if and when they can find the other persons insurance information. Bottom line I’ll end up paying $500 as deductible. My question is why should I pay the deductible if I’m not at fault? What steps can I take to avoid my deductible?

You should contact your local law enforcment and file a police report and give them the contact information for the other driver.

Once you report the damages to the insurance companythey may offer to subrogate the damages. So, instead of going after the other driver directly, you go through your own insurance company. As a result, you give your insurance company the right to go after the the other person to collect their costs. Normally since you are paying through your own insurance policy you will have to pay the deductible, but the insurance company may include the deductible when they collect it from the other driver and reimburse you later.
