Car Insurance Question  My mom excluded my stepdad from her insurance company, he took her car and was involved in an accident. He does not have a drivers license. My mom's car was totalled and lost. Who pays for the damages of the other vehicle? The insurance company is charging my mom and I want to know her rights before we decide whether or not to go to court or pay for the damages of the other vehicle. Please help!

All insurance companies will require that everyone in your household is accounted for in your insurance policy. Household members who do not drive the car must be added to the list of excluded drivers in the policy.

Since your stepdad was excluded from your mom's insurance policy, her policy will not cover your stepdad. In most states, the responsible party (the person driving) would be responsible for their actions, but you should seek legal counsel for clarification.
