Since we are not familiar with the insurance industry and insurance guidelines of Hong Kong, we would suggest reading through the terms of your auto insurance policy and speaking to the claim adjuster on your case as well as the independent loss adjuster to see if you can determine what options you have at this point.
In the US, some state laws and insurance policies allow mediation or arbitration in a situation such as this. For example in Florida there is normally an appraisal clause in your policy which gives you the right to arbitrate your claim if you disagree with your insurance company.
With arbitration, each party chooses, and pays for, a representative. These representatives work together to settle the dispute. Arbitration is binding for you and your company. There is also mediation, during this nonbinding process, a mediator, or neutral third party, encourages the resolution of the dispute without dictating the outcome.
To find out if arbitration or mediation are options for you in HK, speak with the insurance company. If you need further help figuring out the next step to take try contacting the Honk Kong Office of the Commissioner of Insurance and/or the Motor Insurers’ Bureau of Hong Kong.
