My car was stolen recently and I have 2 questions: #1. How long do I have to wait before the car is considered unrecoverable or I get the car replaced by my insurance company in Missouri? #2. If the car is finally found and it is driveable and with no apparent physical damage but I suspect it has been abused or driven recklessly can I refuse to accept the car and demand a replacement?

#1 - Many factors determine how long it will take for your claim to be paid for a stolen vehicle. You may have to wait a specified period of time before your vehicle is considered to be unrecoverable. Most companies have a 48 hour waiting period in the event of a theft. Afterwards, your claims adjuster will begin processing your claim.

Generally the length of time for an investigation and waiting period for a stolen vehicle to be recovered is between 2 weeks to 30 days. An investigation into your stolen vehicle’s comprehensive claim, after the report is filed, takes time.

State laws and insurance companies guidelines differ. To find out if your insurance company and/or the State of Missouri has specific time period for how long the insurance company can wait for the car to be considered unrecoverable, and thus your claim to be settled, check with the Missouri Department of Insurance and the claims adjuster from your insurance provider that is taking care of your claim.

#2 - You would have to read through your policy terms and again speak with your insurance company's agent or claims adjuster to find out what your options are if the car is recovered and you want do not want to take possession of it. For more information on this topic the Missouri DOI should be available for consumer help.
