Car Insurance Question  If someone is charged with a DUI and later convicted can the insurance company just cancel his coverage or is there a procedure?

State laws and insurance company guidelines differ but a driving under the influence conviction could result in an insurance company canceling your policy. In some cases your company may cancel your insurance mid-term or terminate the policy at the end of the term because of your DUI conviction.

If you are canceled in this manner, your company should send you a notice stating why you have been canceled, and then you'll have to find another insurer while now having a cancellation on your insurance claims history. Certain states do not allow insurance companies to drop you in the middle of the policy term, even for a DUI. If you want to know what your state allows, check with your state's insurance regulatory body.

In some cases your policy may stay intact for the time being but when your renewal time comes the insurance carrier will see the DUI conviction and either non-renew you or renew at a high "at-risk" rate due to the seriousness of your offense. Many times after a DUI conviction you will be required to carry an SR-22. If your insurance provider does not offer this insurance certificate then you may need to find insurance elsewhere even if you were not cancelled or non-renewed.

When your insurance company finds out about your DUI conviction in most cases they will increase your rates. The time period which your premiums are increased will again depend on state insurance laws and insurance company guidelines.
