An Administrative License Revocation (ALR) hearing is used in at least a few states so it will depend upon your specific states laws if an SR-22 will be needed when your son is able to reinstate his license after his 6 month revocation.
In Texas, the ALR went into effect on January 1, 1995. This program is the administrative process by which the Department of Public Safety suspends the driver licenses of individuals who are arrested for the offense of driving while intoxicated (DWI). Specifically, an individual may be suspended if he/she either refused to submit to a chemical test or provided a specimen with an alcohol concentration of 0.08 or greater. The DPS is also authorized to suspend the driver licenses of minors who commit the offense of driving under the influence (DUI).
In TX, a driver whose license is suspended in a ALR hearing will receive information from the DPS concerning reinstatement of driving privileges. The license is not automatically reinstated after the suspension period is over, so it is important to carefully follow the instructions provided by DPS.
In Nebraska the ALR is used because persons who drive while under the influence of alcohol present a hazard to the health and safety of all persons using the highways. The NE government decided that a procedure was needed for the swift and certain revocation of the operator's license of any person who has shown himself or herself to be a health and safety hazard (a) by driving with an excessive concentration of alcohol in his or her body or (b) by driving while under the influence of alcohol.
So in this state, the DMV automatically revokes your license when you are arrested for DUI as part of its duty to regulate drivers’ licenses. If you request a hearing then you must show, by a preponderance of the evidence, why your license should be restored to you.
Both of these states require a SR-22 when a suspended or revoked license is reinstated so it is likely that your son will be required to carry one as well but again it depends upon your state laws or statutes. Check with your local Department of Motor Vehicles to see if he will need to carry a SR-22 when he gets his license back.
