Car Insurance Question  I recently got an accident in California. It is the fault of the other driver. My insurance told me the insurance of the other driver will pay for the reparation. But it seems that the person gave me false insurance information and probably don't have any insurance. What should I do? Now, I just have the name of the driver and the licence plate.

According to the California Department of Motor Vehicles each driver involved in an accident that caused more than $750 worth of property damage or injured or killed any person must complete a Traffic Accident Report form SR1 to DMV within 10 days. You may obtain information about the other driver from the accident report that he or she submitted.

To request this information, complete a Financial Responsibility Document Request form SR 19C and mail it to:

Department of Motor Vehicles
Financial Responsibility Unit
P.O. Box 942884
Sacramento, California 942884-0884.

Also available are the other driver's insurance information and a photocopy of the accident report and/or certification that the other driver in the accident was not insured (Uninsured Motorist Certificate). A $20 fee is required for each type.

Even if your damages are under $750 since the other party appears to have given you false information you may still want to contact the Financial Responsibility Unit to see if they can help you obtain either the real insurance information or verify that the other person is uninsured.

If the at-fault party is without insurance then you may need to place your claim with your own collision coverage. If you do not have this coverage then you may need to take the person to court to try and get a judgment against them for your repair costs.
