I had insurance at the time I was pulled over in November in MD. The cop said that for the month of September his records showed I didn't have insurance coverage. He took my plates and made me park the vehicle and gave me citation in which I have to make a court appearance. Is this right and should I get a lawyer for the court date?

It sounds as if your plates were suspended due to your lapse in insurance. Even though you have now purchased insurance it would appear that you have penalties that you will need to face in court due to the gap in auto insurance that you had.

According to the Maryland Motor Vehicle Administration an uninsured owner or owner of a car that has a gap/lapse in insurance could receive penalties such as:

  • Lose of license plates and vehicle registration privileges.
  • Pay uninsured motorist penalty fees for each lapse of insurance - $150 for the first 30 days, $7 for each day thereafter.
  • Pay a restoration fee of up to $25 for a vehicle's registration.
  • Be prohibited from registering any future vehicles until all insurance violations are cleared.
  • Be prohibited from renewing a suspended registration until all insurance violations are cleared.
  • Have license plates confiscated by an authorized tag recovery agent, once a registration suspension is in effect.
  • Pay a fine of up to $1,000 and/or one year imprisonment for providing false evidence of insurance.

It may be that since you have rectified the situation by now obtaining insurance that you will not receive stiff penalties but you should call the clerk of the courts listed on your citation to see if this is the case and if they would recommend you bringing a lawyer with you to court.

If instead the citation is totally incorrect and you did have insurance in September then likely you can just bring proof of insurance for that time period and get the ticket dismissed. If this is your situation, contact the clerk of the courts and find out how to proceed.
