State laws may differ but normally just because a motorist is driving with a suspended license does not automatically make him or her at fault in an accident. Typically, it does not because fault and license status are unrelated.

The police and insurance companies involved should determine fault based on driver statements, witness statements and the actual information on the accident and damages, not due to the fact that one driver was without a valid license.

If a person with a suspended license did hit you then they could be found at fault due to being the one that collided with you. The issue with their license was hopefully noticed by the police and cited by the responding officer. If she was then she will likely get a longer suspension, fines and perhaps other penalties depending upon your state's laws.
